Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Causal Attribution API and SDK (collectively, the "Service") provided by Infinidatum ("Infinidatum," "we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms.
1. Service Provider and Operator
1.1 Infinidatum Role
The Causal Attribution API and SDK are developed, operated, and maintained by Infinidatum, a data science and analytics services provider. Infinidatum is the sole owner of all intellectual property rights in the Service.

1.2 Service Offerings
Infinidatum provides two deployment options:
- Cloud API: Hosted service accessible via https://api.causalmma.com
- Local SDK: Software library for on-premises deployment (requires separate enterprise license)
2. Software License
2.1 Cloud API License
Subject to your compliance with these Terms and payment of applicable fees, Infinidatum grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Cloud API for your internal business purposes during the subscription term.
Restrictions: You may not:
- Reverse engineer, decompile, or disassemble the API
- Redistribute, resell, or sublicense access to the API
- Use the API to build a competing product or service
- Exceed your subscribed rate limits or usage quotas
- Use the API for unlawful purposes or to violate any third-party rights
- Attempt to bypass authentication or security mechanisms
2.2 SDK License (Enterprise)
The SDK is licensed, not sold. Your SDK license agreement includes:
Grant of License:
- Limited, non-exclusive, non-transferable license to install and use the SDK on the number of servers/instances specified in your enterprise agreement
- Right to modify or create derivative works solely for your internal use
- No right to distribute, sublicense, or make available the SDK to third parties
SDK-Specific Restrictions:
- May not remove or obscure any proprietary notices
- May not use the SDK beyond the licensed server count
- May not share license keys with unauthorized parties
- Must maintain the SDK in a secure environment
Source Code: The SDK is provided in compiled/binary form. Source code is not included unless explicitly agreed in writing.
2.3 Intellectual Property
Infinidatum retains all right, title, and interest in and to the Service, including all intellectual property rights. These Terms do not grant you any ownership rights in the Service.
Trademarks: "Causal MMA," "Causal Attribution API," and associated logos are trademarks of Infinidatum. You may not use these marks without prior written permission.
3. Privacy and Data Processing
3.1 Data Handling - Cloud API
When you use the Cloud API:
- Data Processing: Your data is processed on Infinidatum's servers solely to provide the attribution analysis you requested
- Data Retention: API request data is retained for up to 30 days for debugging and support purposes, then permanently deleted
- No Data Sharing: We do not sell, share, or use your data for any purpose other than providing the Service to you
- Data Security: We implement industry-standard encryption (TLS 1.3) and security measures to protect your data
3.2 Data Handling - SDK
When you use the Local SDK:
- 100% Local Processing: All attribution algorithms run entirely on your infrastructure. Your data never leaves your servers
- License Validation Only: The SDK contacts Infinidatum's control plane solely to validate your license key (metadata only, no customer data transmitted)
- Offline Mode: Air-gapped deployments can run in offline mode with no external network calls
- Your Responsibility: You are solely responsible for the security and compliance of data processed by the SDK on your infrastructure

4. Subscription and Payment
4.1 Cloud API Pricing
- Starter: $149/month - 10,000 requests/month, 100 requests/minute
- Professional: $399/month - 50,000 requests/month, 500 requests/minute
- Business: $799/month - 100,000 requests/month, 1,000 requests/minute
- Enterprise: Custom pricing - Unlimited requests, custom rate limits
Billing: Monthly subscriptions are billed in advance. Annual subscriptions receive a 15% discount.
4.2 SDK Licensing Fees
SDK licensing fees are custom-quoted based on server count, data volume, and support level. Typical range: $1,500-$8,000/month.
4.3 Free Trial
We offer a 14-day free trial for all Cloud API plans. No credit card required to start. Trial usage is subject to the Starter plan limits.
4.4 Overage Charges
Requests exceeding your plan's monthly quota will be charged at $0.02 per request. Rate limit violations may result in temporary throttling.
4.5 Refunds
Monthly subscriptions are non-refundable. You may cancel at any time, effective at the end of your current billing period.
5. Acceptable Use
5.1 Permitted Uses
You may use the Service for:
- Marketing attribution and analytics for your own business
- Client work if you are an agency (with appropriate client authorization)
- Research and academic purposes (with proper attribution)
5.2 Prohibited Uses
You may not:
- Use the Service to violate any laws or regulations
- Process data without proper authorization or consent
- Attempt to circumvent usage limits or security measures
- Use the Service to harm, harass, or impersonate others
- Introduce malware, viruses, or malicious code
- Overload or attempt to disrupt the Service (DDoS attacks)
- Use the Service to train competing AI/ML models
6. Warranties and Disclaimers
6.1 Service Availability
We strive to maintain 99.9% uptime for the Cloud API, but we do not guarantee uninterrupted access. Scheduled maintenance will be announced in advance when possible.
6.2 Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
Infinidatum does not warrant that:
- The Service will meet your specific requirements
- The Service will be error-free or uninterrupted
- Results from the Service will be accurate, reliable, or suitable for your purposes
- Any errors or defects will be corrected
6.3 No Professional Advice
The Service provides statistical analysis tools. It does not constitute professional advice (financial, legal, or otherwise). You are responsible for validating results and making business decisions based on your own judgment.
7. Limitation of Liability
7.1 Damages Cap
TO THE MAXIMUM EXTENT PERMITTED BY LAW, INFINIDATUM'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO INFINIDATUM IN THE 12 MONTHS PRECEDING THE CLAIM.
7.2 Exclusion of Consequential Damages
IN NO EVENT SHALL INFINIDATUM BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:
- Loss of profits or revenue
- Loss of data or business opportunities
- Cost of substitute services
- Business interruption
THIS LIMITATION APPLIES EVEN IF INFINIDATUM HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
7.3 Exceptions
These limitations do not apply to:
- Your breach of intellectual property rights
- Your indemnification obligations (Section 8)
- Damages that cannot be limited by law
8. Indemnification
8.1 Your Indemnification Obligations
You agree to indemnify, defend, and hold harmless Infinidatum, its officers, directors, employees, contractors, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:
- Your use of the Service: Any claims resulting from your use or misuse of the API or SDK
- Your data: Any claims that your data or its processing violates third-party rights (privacy, intellectual property, etc.)
- Breach of Terms: Your violation of these Terms or any applicable laws
- Unauthorized access: Claims arising from unauthorized use of your API key or license
- Your products/services: Claims related to products, services, or decisions you make based on Service results
8.2 Indemnification Process
Infinidatum will:
- Promptly notify you of any claim subject to indemnification
- Provide reasonable cooperation in the defense
- Allow you to control the defense and settlement, provided you do not admit liability on Infinidatum's behalf without prior written consent
8.3 Infinidatum's Indemnification (SDK Only)
For SDK enterprise customers, Infinidatum will indemnify you against third-party claims that the SDK infringes intellectual property rights, subject to:
- You promptly notifying Infinidatum of the claim
- Infinidatum having sole control of the defense and settlement
- Your reasonable cooperation in the defense
Infinidatum's sole liability for IP infringement shall be to:
- Obtain the right for you to continue using the SDK, or
- Replace or modify the SDK to be non-infringing, or
- Terminate the license and refund prepaid fees for the unused portion
This indemnity does not apply if the infringement arises from:
- Modification of the SDK by you or third parties
- Use of the SDK in combination with non-approved third-party software
- Your failure to use updates that would have avoided the infringement
9. Data Protection and Compliance
9.1 GDPR Compliance (EU Customers)
For customers in the European Union:
- Data Controller/Processor Relationship: You are the data controller; Infinidatum acts as a data processor when processing personal data via the Cloud API
- Data Processing Agreement: Available upon request for Cloud API customers processing EU personal data
- Data Subject Rights: You are responsible for responding to data subject access requests; we will assist as needed
- Data Transfers: Cloud API servers are located in the United States. We use standard contractual clauses for EU data transfers
9.2 CCPA Compliance (California Customers)
We do not sell personal information. See our Privacy Policy for California-specific rights.
9.3 HIPAA Compliance
The Cloud API is not HIPAA-compliant by default. If you need to process protected health information (PHI):
- Use the Local SDK for 100% on-premises processing
- Contact us for a Business Associate Agreement (BAA) if you require Cloud API with HIPAA compliance (additional fees apply)
10. Termination
10.1 Termination by You
You may terminate your subscription at any time through your account dashboard or by emailing cm-support@infinidatum.net. Termination is effective at the end of your current billing period.
10.2 Termination by Infinidatum
We may suspend or terminate your access immediately if:
- You breach these Terms
- Your account is 30+ days past due
- You engage in fraudulent activity
- Your use poses a security risk
- Required by law or legal process
10.3 Effect of Termination
Upon termination:
- Your license to use the Service terminates immediately
- You must cease all use of the API/SDK and delete any SDK copies
- We will delete your Cloud API data within 30 days (unless legally required to retain)
- No refunds for prepaid fees (except as required by law)
- Sections 2.3 (IP), 6 (Disclaimers), 7 (Liability), 8 (Indemnification), and 11 (General) survive termination
11. General Provisions
11.1 Modifications to Terms
We may modify these Terms at any time. Material changes will be notified via email 30 days in advance. Continued use after changes take effect constitutes acceptance.
11.2 Modifications to Service
We may modify, suspend, or discontinue any aspect of the Service at any time with reasonable notice. We are not liable for any modification, suspension, or discontinuation.
11.3 Assignment
You may not assign or transfer these Terms or your rights without our prior written consent. We may assign these Terms without restriction.
11.4 Governing Law
These Terms are governed by the laws of [Your Jurisdiction], without regard to conflict of law principles. Any disputes shall be resolved in the courts of [Your Jurisdiction].
11.5 Dispute Resolution
For enterprise customers: Disputes shall first be attempted to be resolved through good-faith negotiation. If unresolved within 30 days, disputes may be submitted to binding arbitration under the rules of the American Arbitration Association.
11.6 Entire Agreement
These Terms, together with your order form (if applicable) and our Privacy Policy, constitute the entire agreement between you and Infinidatum regarding the Service.
11.7 Severability
If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect.
11.8 Waiver
Failure to enforce any provision does not constitute a waiver of that provision.
11.9 Force Majeure
Neither party is liable for failure to perform due to circumstances beyond reasonable control (natural disasters, war, pandemics, government actions, etc.).
11.10 Export Compliance
You agree to comply with all export and import laws. You may not use the Service in embargoed countries or provide access to prohibited parties.
11.11 Government Use
If you are a U.S. government entity, the Service is "commercial computer software" subject to restricted rights as defined in FAR 12.212 and DFARS 227.7202.

13. Acknowledgment
BY USING THE SERVICE, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS OF SERVICE.
